Why is it when I have music playing on my desire through headphones, it plays for about 4 - 8 mins then makes the noise for a notification  and completely closes the music player
When I then go into it after its closed its back were is was before I opened it in the first place.
If I'm using the phone while playing music like now it doesn't do it???

Very confusing any help would be much appreciated???

Possibly the headphone plug u are using is activating the remote facility used with the bundled phones because it's intermittantly connecting to the additional jack contacts used for this purpose. Verify this by using a different headphone or at least jackplug.
